Refund & Cancellation Policy

1. Overview

Devortex Solutions LLC provides professional, customized cybersecurity and technology services. This Refund & Cancellation Policy outlines our approach to refunds, cancellations, and dispute resolution for our services.

2. Nature of Services

Our services are professional, customized, and tailored to each client's specific needs. Services may include:

  • Managed Detection and Response (MDR) services
  • Security monitoring and threat detection
  • Incident response support
  • Authorized vulnerability assessments
  • Cloud and infrastructure security consulting
  • Security advisory services

Due to the customized and professional nature of these services, standard refund policies may not apply uniformly to all service types.

3. Refund Policy

3.1 Case-by-Case Review

Refund requests are reviewed on a case-by-case basis, taking into account the specific circumstances, service type, work completed, and terms of the applicable service agreement.

3.2 Eligibility for Refunds

Refunds may be considered in the following circumstances:

  • Service cancellation before work has commenced, subject to any cancellation fees specified in the service agreement
  • Failure to deliver services as specified in the service agreement due to our error or inability to perform
  • Mutual agreement between the client and Devortex Solutions LLC

3.3 Non-Refundable Items

The following are generally not eligible for refunds:

  • Services that have been fully or substantially completed
  • Work performed and deliverables provided
  • Ongoing subscription services after the service period has commenced
  • Third-party costs or expenses incurred on behalf of the client

3.4 Partial Refunds

In cases where work has been partially completed, partial refunds may be considered based on the proportion of work completed and the terms of the service agreement.

4. Cancellation Policy

4.1 Client-Initiated Cancellation

Clients may cancel services by providing written notice to Devortex Solutions LLC. Cancellation terms, including notice periods and any applicable cancellation fees, are specified in the individual service agreement.

4.2 Ongoing Subscription Services

Cancellation will be applicable starting from the next due invoice, until which the client can use the services provided by Devortex normally.

4.3 Project-Based Services

For project-based services, cancellation terms are specified in the applicable statement of work or service agreement. Clients may be responsible for payment of work completed up to the cancellation date, plus any applicable cancellation fees.

4.4 Our Right to Cancel

We reserve the right to cancel or suspend services in cases of non-payment, violation of service terms, unauthorized use, or if required by law. In such cases, refund policies will be applied in accordance with the circumstances and applicable service agreement.

5. Refund Process

To request a refund:

  1. Submit a written refund request to info@devortexsolutions.com
  2. Include your service agreement reference number and reason for the refund request
  3. Allow up to thirty (30) business days for review and processing
  4. We will respond with our decision and, if approved, process the refund within fourteen (14) business days

Refunds, if approved, will be issued to the original payment method used for the transaction.

6. Dispute Resolution

6.1 Good Faith Discussion

We are committed to resolving any disputes or concerns in good faith. Clients are encouraged to contact us directly to discuss any issues before initiating formal dispute procedures.

6.2 Escalation Process

If a dispute cannot be resolved through direct discussion, the matter will be escalated in accordance with the dispute resolution procedures specified in the applicable service agreement.

6.3 Governing Law

Disputes are subject to the laws of the State of Wyoming, United States, and the jurisdiction of courts in Sheridan County, Wyoming, unless otherwise specified in the service agreement.

7. Service Agreement Terms

Specific refund and cancellation terms may be detailed in individual service agreements or statements of work. In case of conflict between this policy and a specific service agreement, the terms of the service agreement shall prevail.

8. Changes to This Policy

We reserve the right to modify this Refund & Cancellation Policy at any time. Material changes will be posted on this page with an updated "Last Updated" date. Changes will apply to new service agreements entered into after the policy update.
